The Honourable Alvin B. Rosenberg, Q.C.

Mr. Rosenberg is a mediator and arbitrator exclusively with ADR Chambers.

In 1983, Mr. Rosenberg was appointed to the Supreme Court of Ontario (now the Superior Court of Justice). He joined ADR Chambers in 1999.

As a mediator and arbitrator with ADR Chambers, Mr. Rosenberg specializes in construction and engineering cases (particularly condominium cases, by-law interpretations, reserve funds and unit owners' rights). He also mediates and arbitrates commercial cases, landlord/tenant cases, and investment disputes.

Mr. Rosenberg received his B.Sc. in Mechanical Engineering from the University of Toronto in 1946. During the period of 1944 to 1945 he was also a member of the Royal Canadian Air Force. From 1946 to 1949 he attended Osgoode Hall Law School and received his LL.B. in 1949.

Following his graduation from law school, Mr. Rosenberg was a member of various law firms in Toronto and then became a senior partner in 1960 of the law firm of Rosenberg, Smith, Walsh & Paton where he carried on a practice in commercial litigation until appointed to the Bench in 1983.

During his legal career Mr. Rosenberg appeared in all levels of the Courts of Ontario as well as in the Supreme Court of Canada where he was Counsel on a number of landmark decisions involving such matters as Landlord and Tenant (Pagelle v. Herbold); Charitable Exemption (Mt. Sinai v. Toronto); and Commercial Cases such as Bills of Exchange. He was counsel on a number of precedent setting condominium construction cases both for the condominium corporation and the developer. He was also counsel on a number of other condominium cases involving by-law interpretation, reserve funds, unit owners' rights, etc. He was also the Founder/President of the Canadian Condominium Institute.

Mr. Rosenberg was involved in a considerable amount of legal writing and was a member of the editorial board of numerous legal publications. He authored the text on Condominium in Canada; as well as Appellate Advocacy; and Appraisal Institute Book for appraisers. He also wrote two Chapters of a legal text by Anger and Honsberger. While on judicial leave from the Bench, Mr. Rosenberg also taught law at the University of British Columbia for one year.

Mr. Rosenberg acted for the Mount Sinai Hospital for 30 years. He served on the Hospital’s Executive Committee for 40 years. As an Officer of the Hospital and as Chairman of the Board, he was involved in a number of hospital and medical issues.

He was a member of numerous legal and judicial organizations including The Canadian Judges Conference and the Canadian Bar Association. His appointments and honourary awards include his appointment as a Queen’s Counsel in 1960; United Jewish Appeal Man of the Year in 1955 as well as Ben Sadowski Man of the Year. He was twice Chairman of the United Jewish Appeal for Toronto and a board member of a number of local Jewish and Israeli organizations.

Over the years, Mr. Rosenberg organized a number of campaigns for political office on behalf of others and ran polling campaigns. Mr. Rosenberg is a Founder of the York Racquets Club, the Palm Beach Tennis Club and honourary counsel of Wymbolwood Beach Association.

Mr. Rosenberg has also been Chairman of a commission of enquiry into a ship sinking and drownings in Lake Erie. After two months of hearings, he made a number of recommendations to the Federal Ministry of Transport on Water Safety, and the recommendations were adopted.
